As the Bangladesh Cricket Board (BCB) refuses to travel to India for the T20 World Cup, the financial implications for their star bowler are becoming clear.

The “Force Majeure” Clause: Why KKR Might Not Pay

Under standard IPL player contracts, a franchise is obligated to pay the full auction price if a player is available for selection. However, legal experts point toward the “Force Majeure” clause.

  • BCCI Intervention: Since the release was mandated by the BCCI due to external diplomatic and security developments (and not a cricket-related injury), it is classified as an extraordinary event beyond the franchise’s control.

  • The Refund: Reports suggest KKR will receive a full refund of ₹9.20 crore into their auction purse. This allows them to sign a replacement player without financial penalty.

  • Liability: Because the withdrawal was directed by the governing body, KKR is likely not legally bound to fulfill the salary payment to Mustafizur.

The Role of the BCB and NOC

A player’s IPL salary is also contingent on their No Objection Certificate (NOC).

  1. If a player is unavailable due to their home board (BCB) withdrawing the NOC, the salary is usually pro-rated (paid only for the days available).

  2. If the player is completely barred from participating before the season starts, they typically forfeit the entire amount.

Could the BCCI Compensate Mustafizur?

While the franchise is off the hook, there is a small window for a “Goodwill Payment.” In past instances where the BCCI has intervened for non-cricketing reasons, the Player Insurance or BCCI Welfare Fund has sometimes been used to provide partial compensation. However, given the current geopolitical tension, such a move is considered unlikely.

“The contract is between the player, the franchise, and the BCCI. If the board cancels the registration of the player for security reasons, the financial burden shifts away from the franchise,” says a sports law analyst.

KKR is now expected to enter the Registered Available Player Pool (RAPP) to find a replacement for the “Fizz.” With ₹9.20 crore back in their pocket, they have the “financial muscle” to target a top-tier overseas seamer.
